Terms of Service

EVPlus is software that helps you analyze sports-prediction markets, surfaces statistical edges between sportsbook consensus prices and Kalshi prediction-market prices, and provides one-click execution of orders against your own Kalshi account using credentials you supply.

EVPlus is not a sportsbook, broker, or financial intermediary. We do not custody your funds, hold positions on your behalf, accept wagers, or operate any betting market. Every trade is executed directly between your browser and Kalshi using your own API key. Your funds, contracts, and positions reside entirely with Kalshi and are governed by Kalshi's own terms.

Information presented in EVPlus - including bet recommendations, edge calculations, Kelly Criterion sizing, the AI analyst chatbot, weather-market signals, and any other quantitative output - is for informational and educational purposes only. It is not investment advice, financial advice, brokerage advice, legal advice, tax advice, or a recommendation to buy, sell, or hold any contract.

We are not registered investment advisors, broker-dealers, commodity-trading advisors, or fiduciaries of any kind. You are responsible for your own decisions. Consult a licensed professional before making financial decisions.

Sports betting and prediction-market trading carry substantial risk of loss, including total loss of capital. Past performance of any model, recommendation, or strategy does not predict future results. The Kelly Criterion and other sizing methods used in this software assume the underlying probabilities are accurate; if our model is wrong, Kelly will recommend bet sizes that lose money quickly. You represent and warrant that:

• You are at least 18 years old, or 21 in jurisdictions where 21 is the minimum age to participate in prediction markets or sports betting;
• You are legally permitted to use Kalshi from your geographic location;
• Your Kalshi account is properly KYC-verified, in good standing, and your own - not held on behalf of another person;
• You will comply with all applicable laws of the jurisdictions where you live and where you use the Service.

EVPlus does not verify your identity or eligibility - Kalshi does. You are solely responsible for legal compliance.

The free tier of the Service can be used without creating an account. Paid tiers (Pro and Pro+) require an account. Accounts are created by entering your email address and clicking a one-time sign-in link ("magic link") we send you. You are responsible for maintaining access to the email address tied to your account; anyone with access to that inbox can sign in to your account.

You may close your account at any time by canceling your subscription (see Section 6) and emailing evpluspro@gmail.com to request data deletion.

Paid tiers are billed monthly via Stripe in U.S. dollars at the prices listed on the Service: Pro at $15.00/month and Pro+ at $25.00/month. Subscriptions renew automatically at the end of each billing period until canceled.

You can cancel at any time through the Stripe Customer Portal accessible from Settings. Cancellation takes effect at the end of your current billing period; you retain access to paid features until then. We do not pro-rate refunds for partial months. If you believe you were charged in error, email evpluspro@gmail.com within 30 days and we'll review in good faith.

Subscription pricing may change with at least 30 days' notice via email. Continued use after a price change constitutes acceptance of the new price.

Auto-trade mode places live orders against your Kalshi account at the price and contract count you arm, without requiring further confirmation. Once enabled, the auto-trade tick fires every 20 seconds while the Auto-Trade tab is open in your browser. Auto-trade entries automatically expire after 24 hours.

You are solely responsible for monitoring armed entries, setting appropriate per-order risk caps, and ensuring auto-trade matches your intent. We are not liable for orders placed by auto-trade for any reason, including software bugs, network errors, market data anomalies, stale recommendations, kill-switch failures, or your own misconfiguration.

You agree not to:

• Use the Service in violation of any law or any term of Kalshi's, the-odds-api's, Anthropic's, or our other vendors' terms of service;
• Attempt to disrupt, reverse-engineer, decompile, or gain unauthorized access to the Service or its underlying infrastructure;
• Circumvent rate limits, scrape data, or use the Service to build a competing product;
• Resell, sublicense, or operate a derivative service for other people without our prior written permission;
• Use the Service to engage in market manipulation, money laundering, structuring, or other illegal activity.

We may suspend or terminate access for violations, with or without notice.

To the maximum extent permitted by law, EVPlus and its operators are not liable for any losses, damages, missed opportunities, fees, taxes, or other harms arising from your use of the Service. This includes (without limitation) incorrect bet recommendations, missing or stale market data, failed or misrouted orders, downtime, security breaches, third-party API outages, decisions you make based on output from the AI analyst chatbot, or any consequence of auto-trade mode.

The Service is provided "as is" and "as available" with no warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

You agree that our maximum aggregate liability to you, regardless of cause and whether sounding in contract, tort, statute, or otherwise, is limited to the greater of (a) the total subscription fees you have paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions don't allow these limitations; in those jurisdictions, our liability is limited to the smallest amount the law permits.

You agree to indemnify and hold harmless EVPlus and its operators from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party right, or your violation of any law.

The credentials you enter into the Service - your Kalshi API key ID and private key, the-odds-api key, and Anthropic API key - are stored exclusively in your own browser's localStorage. They are transmitted to our servers only as in-flight HTTP headers on your individual API requests and are not retained server-side.

We do store, on our servers: your email address, your Stripe customer and subscription identifiers, and your subscription state (tier, status, period end). See the Privacy Policy for full details.

The Service, including its code, design, copy, brand, and underlying models, is owned by EVPlus and its operators and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes consistent with these Terms.

We may update these terms from time to time. Material changes will be highlighted in the dashboard and emailed to active subscribers at least 30 days before they take effect, except when changes are required for legal compliance, in which case they take effect immediately. Continued use after a change constitutes acceptance.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New Jersey, and you and we both consent to the personal jurisdiction of those courts.

You and we both waive any right to a jury trial in any such proceeding. To the maximum extent permitted by law, you waive any right to participate in a class action against us.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
